What is a "Next of Kin" Really For?

The Bank of Ghana promotes financial inclusion, encouraging everyone to have a bank or mobile money account. As part of the "Know-Your-Customer" (KYC) policy, banks need a reliable way to identify and contact you.

This is where your Next of Kin comes in.

  • It's a Contact Person: Your next of kin is your closest living relative (e.g., a spouse, parent, or adult child) whom the bank can contact if you become unreachable.

  • It's for Information: They can provide crucial information about you in case of an emergency or if the bank cannot get in touch with you.

  • Basic Details Required: You typically provide their name, address, and telephone number.

In short, the primary role of your next of kin is to be a point of contact, not a financial beneficiary.

Will My Next of Kin Inherit My Money?

This is the critical misconception the Bank of Ghana wants to address. Nominating someone as your next of kin does NOT mean they automatically inherit your account or its funds when you pass away.

Banking and inheritance are governed by law, not by a simple form filled out at the bank.

So, How Does Someone Actually Access a Deceased Person's Account?

The process is legal and requires court intervention. There are two main scenarios:

1. If the Account Holder Left a Will (Testate)

  • The person who inherits the funds must be explicitly named as a beneficiary in the deceased's Will.

  • That beneficiary must then obtain Letters of Probate from a court.

  • This legal document grants them the authority to access the deceased customer's account and claim the funds.

2. If the Account Holder Died Without a Will (Intestate)

  • The estate is managed according to Ghana's laws of intestacy.

  • Potential heirs must apply to a court to be appointed as Administrators of the estate.

  • The court will issue Letters of Administration (L.A.), which empower the administrators to access the account and distribute the assets according to the law.

To summarize the Bank of Ghana's guidance:

  • The Next of Kin does NOT automatically inherit the account.

  • The Next of Kin does NOT have legal access to the funds.

  •  To access a deceased account, one must provide a death certificate and either Letters of Probate (if there's a Will) or Letters of Administration (if there isn't a Will).

  •  Choose your next of kin wisely. Pick a responsible adult of legal age who knows you well and can provide accurate information about you if needed.
